In these terms, “we”, “us”, and “our” means THE LUXURY EXCHANGE GROUP LTD trading as The ChronoKings. “You” and “your” means the person using our site or services.

2. Scope and Contract Structure

These terms govern:

  1. Use of the ChronoKings website.
  2. Purchases of watches and related products from us.
  3. Sales of watches by you to us.
  4. Any related support, valuation, or transaction services we provide.

By using our site, placing an order, requesting a quote, or selling a watch to us, you agree to these terms.

3. Eligibility

You must be at least 18 years old and have legal capacity to enter binding contracts. We may refuse, suspend, or cancel a transaction where we reasonably suspect fraud, unlawful activity, sanctions risk, or breach of these terms.

4. Important Market Disclaimer

The ChronoKings brand is an independent reseller of pre-owned and, where stated, unworn watches. We are not affiliated with, endorsed by, or an authorized dealer for any watch manufacturer unless explicitly stated.

Brand names, logos, and model names are used for identification and remain the property of their respective owners.

5. Website Content and Listing Information

  1. Listing photos, condition grades, and descriptions are provided in good faith.
  2. Due to lighting, display settings, and the nature of pre-owned goods, actual appearance may vary.
  3. Accessories (box, papers, spare links, hang tags, tools) may be absent unless expressly stated.
  4. Listings are invitations to treat and not binding offers.
  5. We may correct pricing or description errors and cancel impacted transactions before dispatch.

6. Buying From Us (Conditions of Sale)

6.1 Order process

  1. You submit an order through the checkout process.
  2. You receive an order acknowledgement (this is not acceptance).
  3. We perform payment, security, sanctions, anti-fraud, and compliance checks.
  4. A binding contract is formed only when we send dispatch confirmation.

6.2 Price, payment, and fraud controls

  1. All prices are shown in GBP unless stated otherwise.
  2. Prices include UK VAT where applicable and indicated, but exclude delivery, insurance, duties, and import charges unless stated.
  3. Full cleared funds are required before dispatch.
  4. We may request additional identity or source-of-funds evidence before processing.
  5. We may cancel and refund where checks are not satisfactorily completed.
  6. Refunds are made to the original payment method unless required by law.
  7. Customer checkout payments are accepted by bank transfer only.
  8. We use Money X as our payment service provider to facilitate payment processing and transaction controls.

6.3 Delivery and risk transfer

  1. Dispatch and delivery dates are estimates unless expressly guaranteed.
  2. Risk in goods passes to you when delivery is completed at your nominated address or when collected by you or your nominated courier.
  3. If you arrange your own courier or collection, risk passes at collection from our premises.
  4. You must inspect package condition on delivery and report transit damage or shortages promptly with supporting evidence.
  5. We are not liable for damage, loss, or delay caused after risk has passed, including where your own courier is used.
  6. For returns, the parcel remains your risk until physically received by us.

6.4 Right to cancel (distance sales)

If you buy as a UK consumer at distance, you may have a 14-day cancellation right under the Consumer Contracts Regulations 2013.

  1. Cancellation period: 14 days from delivery.
  2. You must notify us clearly in writing within that period.
  3. You must return goods within 14 days of cancellation notice.
  4. You are responsible for return packaging, insurance, and safe transit unless goods are faulty or misdescribed.
  5. We may reduce your refund for diminished value resulting from handling beyond what is necessary to inspect the goods.

Exclusions may apply where permitted by law (for example, sealed products unsealed after delivery for hygiene reasons, or bespoke/modified items made to your specification).

6.5 Faulty, misdescribed, or not as expected goods

Nothing in these terms limits your statutory rights under the Consumer Rights Act 2015. If goods are faulty, not as described, or not of satisfactory quality (taking account of their pre-owned nature), contact us promptly and we will handle your claim in line with applicable law.

6.6 Authenticity and modifications

  1. We conduct checks we consider reasonable before sale.
  2. If any authenticity issue is confirmed by us after sale, we will provide a remedy in line with law and any applicable warranty terms.
  3. Unauthorized third-party opening, alterations, non-genuine part installation, or tampering after sale may invalidate any voluntary warranty we provide.

6.7 Warranty (if offered)

Any ChronoKings warranty is in addition to your statutory rights and is governed by the specific written warranty terms issued with the watch.

7. Selling To Us (Conditions of Purchase)

7.1 Initial quote and final offer

  1. Any initial quote is indicative and non-binding.
  2. Final offer is issued only after physical inspection and compliance checks.
  3. We may revise or withdraw offers where condition, provenance, market values, or disclosures differ from submitted information.

7.2 Your warranties to us

By selling a watch to us, you warrant that:

  1. You are the legal owner and entitled to sell.
  2. The watch is not stolen, counterfeit, cloned, or subject to finance, lien, or third-party claim.
  3. Description, provenance, serial details, and supplied documentation are complete and accurate.
  4. You have disclosed all known defects, repairs, modifications, replacement parts, and service history.
  5. You have complied with applicable tax, customs, and import/export laws.

7.3 Compliance checks and law enforcement

We may perform due diligence checks, including checks against lost/stolen or fraud databases. If a watch is flagged or suspected unlawful, we may retain the item and report to relevant authorities where legally required.

7.4 Shipping to us and allocation of risk

  1. Unless we expressly agree otherwise, risk remains with you until the watch is physically received by us or our designated courier.
  2. You are responsible for secure packaging and adequate insurance when shipping.
  3. We are not responsible for damage, loss, or non-receipt resulting from inadequate packaging or shipping non-compliance.

7.5 Payment

  1. Payment is made only after final offer acceptance and completion of required checks.
  2. Payment is made to a bank account in your own name, unless we agree otherwise.
  3. We may hold payment pending unresolved fraud/compliance concerns.
  4. We may offset sums you owe us against sums we owe you where lawful.

8. Part Exchange and Consignment (if offered)

Where we offer part exchange or consignment, additional written terms apply and prevail in case of conflict with these general terms.

9. Customs, Duties, CITES, and Export Controls

  1. Cross-border transactions may trigger duties, import VAT, brokerage charges, and CITES/material restrictions.
  2. You are responsible for legal compliance and charges in your jurisdiction unless we explicitly agree otherwise.
  3. We may cancel transactions where legal export or import is not possible.

10. Anti-Money Laundering, KYC, and Sanctions

We may request identity and transaction information to comply with anti-money laundering, counter-terrorist financing, sanctions, and fraud prevention obligations. We may pause, refuse, or cancel transactions where required checks are not satisfied.

11. Payment Disputes and Reversals

Where a payment dispute or payment reversal is raised, we may suspend related account activity, retain goods or proceeds where lawful, and recover losses, fees, and costs resulting from fraudulent or wrongful payment activity.

Where transactions are processed through Money X, relevant payment disputes and verification checks may be managed through that payment route in accordance with applicable law and provider process.

12. Liability

  1. Nothing in these terms excludes or limits liability that cannot be excluded under law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.
  2. Subject to clause 12.1, we are not liable for indirect or consequential loss, loss of profit, loss of opportunity, loss of goodwill, or reputational harm.
  3. Subject to clause 12.1, our total liability in connection with any purchase is limited to the amount paid by you for the relevant item.
  4. Subject to clause 12.1, our total liability in connection with any sale by you to us is limited to the final agreed purchase price for that item.

13. Indemnity

You agree to indemnify us for losses, liabilities, costs, and reasonable legal expenses arising from your breach of these terms, false warranties, unlawful conduct, or infringement of third-party rights.

14. Intellectual Property and Site Use

All content on this site, including text, graphics, logos, photos, and software, is owned by us or our licensors. You may not copy, scrape, reproduce, republish, or commercially exploit site content without prior written consent.

15. Account Suspension and Termination

We may suspend or terminate your account or restrict transactions where we reasonably believe there is fraud risk, security risk, legal non-compliance, abuse, or material breach of these terms.

16. Force Majeure

We are not responsible for delay or failure caused by events outside our reasonable control, including courier disruption, customs holds, severe weather, cyber incidents, utility failures, strikes, war, terrorism, pandemic events, and governmental action.

17. Notices

Where these terms require notice, notices must be sent by email to admin@thechronokings.com, via our website contact form, or by post to our registered office.

18. Changes to These Terms

We may update these terms from time to time. The version in force at the date of your order or transaction request will apply unless a legal requirement requires immediate change.

19. Governing Law and Jurisdiction

These terms and any non-contractual obligations are governed by the laws of England and Wales.

If you are a UK consumer, you may bring claims in the courts of your place of residence in the UK. If you are not a consumer, the courts of England and Wales have exclusive jurisdiction.

21. Insurance and Customer Protection Notice

To support secure trading in high-value goods, we maintain business insurance arrangements through specialist jewelry/watch-market providers. Coverage is subject to insurer terms, limits, exclusions, conditions, and underwriting approval in force at the relevant time.

Current insurance arrangements may include cover elements such as:

  1. Public liability cover (up to applicable policy limits).
  2. Products liability cover (up to applicable policy limits).
  3. Damage to premises cover (where applicable under the active schedule).
  4. Specified stock and sendings cover, including limits for transit methods and article values.
  5. Pound breach and defective title cover up to applicable policy limits.
  6. Assault-related personal accident benefits for declared insured persons, subject to schedule limits and policy conditions.

Important:

  1. Insurance does not replace your statutory rights under UK consumer law.
  2. Insurance details may change at renewal or endorsement; the active policy schedule and wording always govern.
  3. Not all risks are insured, and some sections may be “Not Included” under the current schedule.
  4. Specific transaction protection (for example escrow, payment-dispute handling, courier limits, and fraud checks) is governed by these Terms, checkout terms, and any transaction-specific written agreement.

22. Complaints and Escalation

If you have a complaint, please contact us first at admin@thechronokings.com so we can investigate and resolve it promptly.

If we cannot resolve your complaint directly, you may be able to escalate the matter through external channels, including the National Association of Jewellers (N.A.J.), where relevant to the issue and subject to any applicable scheme scope or eligibility rules.

N.A.J. Membership reference: NAJ-73735.

23. N.A.J. Membership and Consumer Information

N.A.J. membership supports customer confidence through:

  1. A professional Code of Conduct framework for member businesses.
  2. Access to independent dispute resolution routes (including N.A.J. Resolve, where applicable).

Important:

  1. N.A.J. membership is not an insurance or compensation guarantee.
  2. N.A.J. membership does not replace your statutory rights.
  3. Your rights remain protected under applicable UK consumer law, including the Consumer Rights Act 2015 and related regulations.

Consumer-facing wording approved for website use:
“As an NAJ member, The ChronoKings operates under professional industry standards and customers may have access to independent dispute resolution through NAJ Resolve where applicable. NAJ membership is not an insurance or compensation guarantee and does not replace statutory consumer rights.”
